The Law Society of Kenya (LSK) has filed a petition with the High Court of Kenya at Milimani, citing alleged contraventions of constitutional rights and fundamental freedoms. This case, lodged under Constitutional Petition, involves multiple high-profile respondents, including the Cabinet Secretary for Agriculture and Livestock Development, Mithika Linturi, and other key parties implicated in a fertilizer scandal.
The LSK’s petition addresses serious concerns over the procurement and distribution of substandard fertilizer, which has resulted in severe losses for farmers and heightened food insecurity in the country. The petition was mentioned in court on 4th July 2024, with most respondents, including the Cabinet Secretary , yet to file their responses to the application for the disclosure of pertinent documents.
In a move to ensure comprehensive accountability, the court has granted an extension for the filing of responses and submissions. Further directions will be issued following this process. The LSK remains steadfast in its commitment to holding all involved parties accountable and ensuring transparency for the Kenyan public.
This case underscores the critical importance of regulatory oversight in the agricultural sector and the need for stringent measures to prevent similar incidents in the future.
